In recent days, reports have surfaced suggesting a possible European ban on connected V16 beacons. This interpretation has generated doubts among Spanish drivers and some uncertainty about whether the requirement would still be in effect.

The regulatory reality is clear: The connected V16 beacon remains mandatory in Spain in 2026 and there is no suspension or repeal in effect.

What has really happened to the European Commission?

The controversy stems from a parliamentary response from the European Commission indicating that Spain did not formally notify the Royal Decrees relating to the V16 beacon in accordance with Directive (EU) 2015/1535.

This is the only confirmed fact.

It does not exist:

• Beacon prohibition.
• Suspension of the obligation.
• Repeal of the rule.
• Infringement proceedings are currently open.

The issue raised by the Commission relates to an administrative procedural aspect, not to the substance of the measure or its objective in terms of road safety.

The obligation in Spain remains fully in force.

From January 1, 2026:

• The connected V16 beacon is the only legal vehicle pre-signaling system in Spain, including cars, vans, buses and trucks.
• The beacons that are not connected are no longer valid.
• The €80 fines are being applied.

There is no grace period or moratorium. For penalty purposes, not having an approved and connected beacon is equivalent to not having any signaling system at all.

The rule is in force and failure to comply will have immediate economic consequences.

Can the rule be changed in the future?

In legal terms, any national law can be reviewed at the European level. However, the procedure would be lengthy and complex. It would require the formal opening of infringement proceedings, a period for the State to submit its arguments, a possible referral to the Court of Justice of the European Union, and, if applicable, a final judgment requiring the regulation to be amended.

Currently, none of these steps have taken place.

Meanwhile, the obligation remains fully active in Spain.

What requirements must a V16 beacon meet to be valid in 2026?

For a V16 beacon to be legal in 2026 it must:

• To be included in the official list of certified devices of the DGT.
• Incorporate integrated connectivity and geolocation.
• Transmit the signal to the DGT 3.0 platform when activated.
• Be certified by an accredited laboratory in accordance with applicable regulations.

Any device that does not meet these requirements is invalid.
