The transport employers' association is demanding an urgent review of the IPREM (Public Indicator of Multiple Effects Income) due to the loss of more than 80% of the compensation value.
La National Federation of Transport Associations of Spain (Fenadismer) has claimed the immediate update of compensation amounts for vehicle immobilization in road freight transport, considering that current amounts are seriously outdated and do not reflect the real costs borne by carriers.
According to the employers' association, these amounts remain frozen since 2022 as a consequence of the absence of a new General State Budget. This is compounded by the change to the benchmark index approved in 2009, which has caused a reduction of more than 80% of the real value of the compensation due to paralysis.
Right to compensation for vehicle immobilization
La Land Transport Contract Law, approved in 2009, recognizes the carrier's right to claim from the shipper a compensation for work stoppage when the vehicle has to wait more than one hour to complete the loading or unloading of the goods. This same criterion applies in any other situation in which the vehicle is immobilized for reasons not attributable to the carrier, such as accidents or disasters.
However, this regulation modified the calculation system that had existed until then in the Land Transport Management Law, which used as a reference the Minimum Interprofessional Salary (SMI).
The IPREM, an outdated and frozen index
Since 2009, the compensation amount has been calculated based on the IPREM (Public Indicator of Income for Multiple Effects), an index that is approved annually through the General State Budget Law and from which the last officially published value is taken as a reference.
Fenadismer believes that this change has been especially harmful to the sector, since the IPREM It has not been updated regularlyeven in fiscal years with approved budgets, as happened in 2010, 2011 and 2012. The situation has worsened in the last three years, in which the budget law has not been processed, maintaining the IPREM frozen since 2022.
A gap of more than 80% compared to the minimum wage
The employers' association emphasizes that, while the Minimum Interprofessional Salary has experienced a cumulative increase of over 95% between 2009 and the agreed forecast for 2026The IPREM has barely increased around 13% in the same periodThis divergence has generated a lag greater than 80% in compensation for work stoppages, to the clear detriment of the carriers.
Urgent request to the Ministry of Transport
Given this situation, Fenadismer will demand that Ministry of Transport that promotes with urgent and extraordinary character the approval of a specific legislative norm that allows the Immediate update of the IPREM for 2026, with a substantial increase compared to the current value.
The federation considers this measure essential for restore economic balance in road transport and ensure fair compensation for stoppages and damages suffered by vehicles in the course of their professional activity.
